Terms of service

1. Scope of application

The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his or her commercial nor to his or her independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or self-employed professional activity.

 

2. Contractual partner, conclusion of contract, correction options

The purchase contract is concluded with Les Lunes GmbH (haftungsbeschränkt).

By placing the products in the online shop, we make a binding offer to conclude a contract for these articles. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive a confirmation by e-mail.

 

3. Contract language, contract text storage

The language available for the conclusion of the contract is German.

We store the contract text and send you the order data and our AG by e-mail. You can view the contract text in our customer login.

 

4. Delivery conditions

The shipping costs for France, Germany and Austria are covered by us from a value of goods of 79€, for a value of goods below 79€ they amount to 3,80€.

The shipping costs to Switzerland are paid by us from a value of goods of 99€, for a value of goods below 99€ they amount to 20€.

The shipping costs to Belgium, Luxembourg and the Netherlands are paid by us from a value of goods of 99€, for a value of goods below 99€ they amount to 9,90€.

Shipping costs to all other countries will be charged at 20€.

Any customs duties and local taxes are to be paid by the recipient.

We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.

If you order several items within the scope of one order, for which different delivery times apply, we will send the goods (unless otherwise agreed) in a joint shipment. In this case, the delivery time that applies to the item in your order with the longest delivery time will apply to your goods order as a whole.

 

5. Payment

The following payment methods are generally available in our shop:

 

Credit card

When you place your order, you also send us your credit card details.

After your legitimation as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after the order. The payment transaction will be carried out automatically by the credit card company and your card will be charged.

Amazon Pay

During the ordering process, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and legitimise yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online shop where you can complete the ordering process.

Immediately after placing the order, we will request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further instructions during the ordering process.

Klarna

In cooperation with Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden, we offer the following payment options. The payment is made to Klarna in each case:

Invoice

The payment period is [14] days from the date of dispatch of the goods/ticket/ or, in the case of other services, the provision of the service. The complete invoice conditions for the countries in which this payment method is available can be found here:  GermanyAustria.

Instalment purchase

With Klarna's financing service, you can pay for your purchase in fixed or flexible monthly instalments under the conditions specified in the checkout. The instalment payment is due at the end of each month after Klarna sends you a monthly invoice. Instant bank transfer

Available in Germany, Austria, Belgium, Italy, Spain, Poland and the Netherlands. Your account will be debited immediately after placing the order.

Direct debit

Available in Germany, the Netherlands, Sweden and Austria. The debit will be made after the goods have been dispatched. You will be informed of the time by e-mail.

The use of the payment methods invoice, hire purchase and direct debit requires a positive credit assessment. In this respect, we forward your data to Klarna for the purpose of address and creditworthiness checks as part of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permissible based on the results of the credit check. Further information and Klarna's terms of use can be found here. 6. Retention of title

The goods remain our property until full payment has been made.

7. Transport damages

If goods are delivered with obvious transport damage, please complain about such defects to the delivery company as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

 

8. Warranty and guarantees

Unless otherwise expressly agreed below, the statutory liability for defects shall apply.

In the case of used goods, the following applies: if the defect occurs after the expiry of one year from delivery of the goods, the claims for defects are excluded. Defects occurring within one year of delivery of the goods may be claimed within the statutory limitation period of two years from delivery of the goods.
The above restrictions and shortening of the period shall not apply to claims based on damage caused by us, our legal representatives or vicarious agents
• in the event of injury to life, limb or health
• in case of intentional or grossly negligent breach of duty as well as fraudulent intent
• in the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
• within the scope of a guarantee promise, insofar as agreed, or
• insofar as the scope of application of the Product Liability Act is opened.

9. Liability

For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without restriction
• in case of injury to life, body or health
• in case of intentional or grossly negligent breach of duty
• in the case of warranty promises, insofar as agreed, or
• insofar as the scope of application of the Product Liability Act is opened.
In the event of a breach of essential contractual obligations, the fulfilment of which is a prerequisite for the proper performance of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, the amount of liability shall be limited to the damage foreseeable at the time of the conclusion of the contract, the occurrence of which must typically be expected.
Otherwise, claims for damages are excluded.

 

10. Dispute resolution

We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration board.
